PRIVACY POLICY

 

This Policy explains how your Personal Data is collected, used, and disclosed by the individual entrepreneur Yevhenii Mykolaiovych Polievoi, acting on the basis of an Extract from the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Associations (hereinafter – IE).

  1. TERMS

1.1. Personal Data (hereinafter – PD) – any information or set of information about an individual (personal data subject) who is identified or can be specifically identified.

1.2. Processing of personal data – any action (operation) or set of actions (operations) performed using automation tools or without using such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (dissemination, provision, access), anonymization, blocking, deletion, destruction of personal data.

1.3. Confidentiality of personal data – the obligation to take actions that do not allow the dissemination of PD without the consent of the personal data subject.

1.4. Personal Data Subject (PDS):

A person who is potentially a Customer of the Product, as defined by the Public Offer posted on the Website, and who has provided their personal data on their own initiative.

A person who has made a payment and is a Purchaser of the Product, as defined by the Public Offer posted on the Website.

1.5. Product – goods, images, and descriptions of which are posted in the Online Store at the link: https://companygroupteam.com, including clothing and accessories, which the IE sells to the PDS within the framework of the Public Offer.

  1. PERSONAL DATA TO BE COLLECTED

2.1. Personal data permitted for processing for the purposes of this Privacy Policy are provided by the Personal Data Subject independently when placing an Order for Goods with the IE, paying for the Goods, and include the following information:

– surname, name, patronymic;
– phone;
– email address;
– delivery address for the Product;
– any other personal information that the Subject (PDS) has provided at their own discretion.

2.2. In addition, the Website may collect information generated during its use, including information about the time, frequency, and conditions of its use, IP addresses of the electronic computing device (computer, phone, tablet, etc.), addresses of previous web pages from which access to the website was obtained, etc.

 

  1. PURPOSES OF PERSONAL DATA COLLECTION AND PROCESSING

3.1. Purposes:
– identification of the person, correspondence within the Public Offer, activities of the Website;
– providing the Personal Data Subject with special offers, price information, newsletters, and other information from the IE, including sending messages, requests, and information related to the Product, as well as processing requests and applications from the former;
– conducting statistical, marketing, and other research based on the provided data; 
– administering the Website and the IE's business;
– carrying out operations with payment systems, services;
– ensuring advertising activities;
– fulfilling obligations to users, clients, partners; 
– for other purposes necessary for providing services to the client, the IE's activities.

 

  1. DISCLOSURE OF PERSONAL DATA

4.1. Disclosure of PD is permissible in the following cases:

– to any of the IE's employees, partners involved in providing services for the sale of Goods, as stipulated in the Public Offer, to the extent and for the purposes defined therein and by the IE's activities;
– to third parties, including courier services, postal organizations, if necessary for the delivery of the ordered Product;
– if required by current legislation, regulatory provisions in the manner prescribed by current legislation, a request from government agencies, or if data disclosure is necessary for security reasons or similar reasons;
– to law enforcement representatives, healthcare institutions, other government agencies, and other third parties, as well as in case of claims or disputes related to the IE's activities;
– in connection with any current or future legal proceedings;
– for the purpose of establishing, exercising, or defending the IE's legal rights (including providing information to other parties to prevent fraud or reduce credit risks, financial monitoring control risks);
– to the buyer (or potential buyer) of any business or assets that the IE sells (or plans to sell);
– other cases where non-disclosure of personal data may harm the IE's activities.

4.2. In other cases, the IE will not disclose your PD to third parties, except for the cases specified in the Privacy Policy.

 

  1. CONFIDENTIALITY OF SERVICES

5.1. With this Policy, the IE guarantees to take actions that ensure the safety of data transferred to it within the framework of the Public Offer.

5.2. The IE guarantees to limit the circle of persons involved in providing services for the purchase and sale of Goods within the framework of the Public Offer, for the purpose of business functioning, to its employees and contractors.

5.3. The IE does not process personal data regarding bank accounts, bank cards, payment information, etc.; the relevant bank, remote banking systems, money transfer services process such data in accordance with their Privacy Policy or other documents.

 

  1. ADDITIONAL PROVISIONS

6.1. The basis for processing personal data is consent, the existence of which is confirmed by the actions of the PDS in transferring them to the IE in messengers, social networks, Google forms, the Website, including by performing conclusive actions by creating an order, purchasing the IE's Goods, and accepting the Public Offer.

6.2. By providing their personal data, the Personal Data Subject guarantees that they are currently and will remain true, accurate, complete, and up-to-date. Otherwise, in case of changes, they undertake to notify the IE within 5 business days.

6.3. The IE has the right to make changes to this Privacy Policy without the consent of the Personal Data Subject.

6.4. The IE is responsible for the dissemination of PD only if its fault is proven in court. The IE is not responsible for the actions of the PDS or persons involved by them that led to violations.

6.5. The new Privacy Policy comes into force from the moment it is posted on the Website, unless otherwise provided by the new version of the Privacy Policy.

6.6. In case of disagreements arising from this Privacy Policy, the Parties are obliged to take steps to resolve them out of court, by sending a claim. In case of failure to reach an agreement between the Parties within 30 calendar days, the dispute will be submitted to court in accordance with the current legislation of Ukraine.

6.7. You acknowledge that the transmission of information over the Internet is inherently insecure, and the IE cannot guarantee the security of data sent over the worldwide web.

6.8. The Website, services, electronic resources (platforms), messengers may contain links to other websites/resources. The IE is not responsible for the privacy policy of these websites/resources. We recommend that you familiarize yourself with the privacy policy of these websites/resources before providing any information.

6.9. By your actions of transferring personal data, including conclusive actions, YOU, as the Personal Data Subject, give consent to the processing of your personal data.
